Courts Decide Opposing Trump Administration on Removing Central American Children and Venezuelan Nationals
In a major legal setback, federal judges have blocked moves by the administration to deport unaccompanied immigrant Guatemalan children and to terminate temporary protected status for many of Venezuelans residing in the US.
Ruling Stops Deportation of Children
The court on Thursday directed the government to stop deporting unaccompanied immigrant minors who have ongoing legal proceedings.
Judge Timothy Kelly, based in Washington DC, maintained an previous injunction and criticized the government’s claim that parents of the minors had requested their return.
Evidence indicated that many of the guardians were unreachable or did not want their children to be sent back to Guatemala.
The justice department’s explanation “crumbled like a house of cards” in light of contrary reports.
According to testimony, some children were awakened from their shelter beds in the early hours, transported to airports, and in some cases, placed onto planes without adequate preparation.
Higher Court Denies Request to Revoke Venezuelan TPS
Another ruling, a circuit court refused to pause a previous decision that blocked the termination of temporary protected status for approximately 600,000 Venezuelan immigrants.
A three-judge panel noted that ending temporary protected status would subject Venezuelan citizens to serious danger, including deportation, separation from loved ones, and loss of employment.
The Department of Homeland Security spokesperson characterized the decision as “open defiance” to the higher judicial authority, suggesting that the administration may appeal the matter to the Supreme Court.
Background on Temporary Protected Status
Temporary Protected Status is a policy that offers work authorization and deportation protection to qualifying immigrants from nations experiencing environmental crises, war, or other extraordinary conditions.
Established in 1991, the program was later extended to include Venezuelans and people from Haiti under previous administrations.
Recent attempts to roll back these extensions have triggered several lawsuits across the United States.
