Former President Trump Seeks Top Court Permission for National Guard Personnel in Illinois
On Friday, the administration filed an emergency request to the US supreme court, seeking clearance to deploy military reserve troops to Chicago and surrounding areas.
This step is part of a larger campaign to increase the domestic use of the armed forces in a number of urban centers under Democratic control.
Legal Battle Over Guard Activation
In an urgent petition, the justice department pressed the court to set aside a earlier court order that had stopped the deployment of hundreds of military reserve personnel to the Chicago region.
The presiding judge had raised doubts about the White House's reasoning for activating the guard, questioning its rationale in light of local conditions.
A federal appeals court affirmed the previous order on midweek, keeping the deployment on hold while the legal challenge continues.
Administration's Claims
The top government lawyer, acting for the government, wrote in the new filing that government officers have repeatedly been “intimidated and assaulted” in the city of Chicago and the suburb of Broadview area.
This area is home to an ICE detention center.
The former president has earlier sent military reserve forces to Chicago and Portland, subsequent to previous deployments to Los Angeles, the city of Memphis, and Washington DC.
The White House has stated that armed forces involvement is required to reduce protests and strengthen border control.
Ideological Resistance
Opposition leaders have strongly opposed the action, saying that the White House's statements are inflated and partisan in nature.
They charge the president of exploiting his authority to retaliate against critics.
Court officials have also raised questions about the White House's description of events.
City officials claim that protests over deportation policies have been mostly modest and peaceful, contrasting with the administration's characterization of “war zone” circumstances.
Statutory Grounds
At the core of the conflict is the government's invocation of a national law allowing the commander-in-chief to nationalize the military reserve only in situations of insurrection or when “powerless with the standard military to carry out the regulations of the nation”.
The government argues that the personnel are required to protect US facilities and personnel from demonstrators.
Recent Actions
In recent weeks, the White House federalized 300 troops of the Illinois military reserve and directed more Texas-based personnel into the Illinois.
As state authorities criticized the decision, the former president intensified his language, urging the arrest of Chicago’s mayor and the state's chief executive, the two Democratic officials, charging them of neglecting to protect federal agents.
The state of Illinois and Chicago jointly sued the White House to stop the sending.
On 9 October, the presiding federal judge, a Biden appointee, issued a temporary injunction preventing the directive.

Meanwhile in Chicago, at least 11 people were detained outside the ICE facility in Broadview following serious disputes between local police and demonstrators.
